Transcript | New Orleans, LA. July 17, 1908 Messrs Winans Wall, Johnston Armstrong, Gustave Lemle, New Orleans. Gentlemen: As the agents and attorneys in fact of Andrew Wood Smythe [Smyth?], noting under the power of attorney enclosed, we beg to confirm our understanding of the agreement entered into with you for and in behalf of our principal Andrew Wood Smythe [Smyth?], to be, as follows: You are all to take necessary steps to locate and recover any and all property that may belong to Andrew Wood Smythe [Smyth?], or in which he may have an interest, situated in the State of Louisiana, and to that and you are authorized to institute suits and other legal proceedings necessary to recover said property, and to prosecute the same to final conclusion. All costs incident to the litigation are to be advanced by you. You are further to provide the necessary money to settle with the [Conery?] and McCann heirs. Out of any property recovered, you are to be reimbursed the money expended by you in costs and payment of Conery and McCann heirs, with six per cent per [annum?] interest from date of payment, and whatever remains shall be divided between you and Andrew Wood Smythe [Smyth?], or his heirs, in the proportion of one-third to you and two-thirds to Andrew Wood Smythe [Smyth?], or his heirs. You are also to adjust matters with Messrs Richardson and Curley. Any sum you may have to pay them in no event, however, to exceed ($5,000) five thousand dollars, is to be deducted from the two-thirds coming to Andrew W. Smythe [Smyth?] or his heirs. As Mr. Gustave Lemle, is a party to the contract, and is acting as the agent and attorney of Mr. Smythe [Smyth?] in Ireland, and by his ratified and approved of. Please let us know during the day, if the above is as you understand it, and if so, we will forward the letter at once, to Mr. Smythe [Smyth?], with the request that he let us have an immediate reply.
