Transcript | IN RE R. C. MINOR A. H. ASHLEY MINOR & ASHLEY ATTORNEYS AT LAW WILDOIT BUILDING STOCKTON, CAL [Calfornia?] Stockton, California January 4th, 1899 Joshua E. Peel Esq., Armagh, Armagh Co., Ireland. My Dear Sir : - I ask of you the doing of the things hereinafter set out, for which I agree to pay the sum of five dollars for your services, and, in addition, the costs of obtaining certified copies of such documents as may be necessary. The matter in hand is this: One Patrick Tegart [Taggart?] died testate in the city of Stockton, State of California, on December 13th, 1861, leaving as his devisees, his sisters, Mary Tegart [Taggart?] and Susan Martha Tegart [Taggart?], both spinsters; and in the event of the death of Mary and Susan Martha Tegart [Taggart?] to Mrs. Sarah McDonnell, a widow residing in your said county. This will was duly admitted to probate here in January, 1862, and the estate was in due time closed. Mary Tegart [Taggart?] and Susan Martha Tegart [Taggart?] executed powers of attorney to Dr. G.A. [Shurtleff?] of this city, empowering him to grant and convey all the property of the estate of Patrick Tegart [Taggart?] situated in the State of California. There are on file here the following papers : (1) Certified copy of the entry made in the Register Book of Deaths in the district of Tandragee, County of Armagh, showing that Susan Martha Tegart [Taggart?], a spinster, died at the age of 58 years, on the 20th day of June, 1880, and that Mary Tegart [Taggart?], a spinster, died on April 16, 1882, at the age of 70 years. (2) Cerified copies of letters of administration upon the personal effects of Mary Tegart [Taggart?], deceased, issued out of the High Court of Justice, Probate and Matrimonial Division, on July 16, 1882, to Sarah McDonnell, a widow, of Rose Cottage, Mullahead, County Armagh. On November 25th, 1882, said Sarah McDonnell executed a power of attorney to the same Dr. G.A. [Shurtleff?], reciting that she was then the owner of all property belonging to the said Patrick Tegart [Taggart?] in the State of Cailfornia, and empowering said [Shurtleff?] to convey the same. Conveyances of the property of Patrick Tegart [Taggart?], under these powers of attorney, were made many years ago, and long enough to clothe the present occupants and owners with title by adverse possession. You will observe from the foregoing statement that we have nothing of record here to show that Sarah McDonnell is or was the sole heir of Susan Martha Tegart [Taggart?], except her assertion to that effect in the power of attorney referred to, and what we desire of you is, to ascertain if there has been any administration upon the personal effects of Susan Martha Tegart [Taggart?], deceased, and if there has been, to send us a certified copy of the document issued by the Court declaring Sarah McDonnell to be the sole heir of said Susan Martha Tegart [Taggart?], deceased, if there is any such paper (other than the certified copy of the letters, which we alreadty have), declaring Sarah McDonnell to be the sole heir of said Martha Tegart [Taggart?]. We do not presume there is any doubt of the fact that Sarah McDonnell is the sole heir of both Susan Martha Tegart [Taggart?] and Mary Tegart [Taggart?], and what we desire is the obtaining of some document wherein that relationship is established, in order to place it of record here. We should like to know, also, if Sarah McDonnell is still alive; if dead, the time of her death, the names and ages of her children, and if any administration has been made upon her estate. If you desire the sending of the money before acting, so write and I will remit. - the writer was formerly a member of the firm of Minor & Ashley, who were subscribers to the International Law Directory, from which I have taken your name.
