Transcript | J.E.COOK. R.E.LEACH. COOK & LEACH, ATTORNEYS-AT-LAW. INDEPENDENCE, IOWA. June 23. 1902. Joshua E. Peel & Son, Armagh, Ireland. Gentlemen:- Your two letters of 11th inst. in relation to the property of Rose Hegarty and the heirs of Agnes Duffy received and also power of attorney from Rose Hegarty to our Mr. Cook. We think that you have furnished us with all the facts in the case that are necessary and in order to perfect the title to the property so it can be sold, we shall have to commence a suit in partition, making Rose Hegarty, plaintiff, and Katherine Branigan defendant and vice versa and bringing in the others as defendants, Rose, Mary and Michael; also other unknown heirs. Under our statute, we have a right to bring all parties in Court by publishing the same in our paper. We name Rose, Mary and Michael as defendants and then bring in unknown heirs, grantees or legatees or any party that may possibly have any interest in the property; it also brings any party that may be interested in the property before the courts, so that the Court has full jurisdiction and an adjudication as to the ownership of the property is final and binding on everybody, and the purchaser from the referee will obtain a good title. Enclosed find petition for Katherine to sign and swear to before the Deputy Consul and return to us. and we will get a sale of the property as soon as possible. Yours truly, Cook & Leach |
